Terms of service
These terms apply when you create a Motorbay account and use the Motorbay API and Motorbay Console. By creating an account you accept them.
Who we are
Motorbay is run by Lukas Ryborg Dreier and Simon Christensen as a partnership (interessentskab). The business is not registered in the CVR register yet. Our address and phone number are in the footer of every page. You can reach us at support@motorbay.app.
What Motorbay is
Motorbay gives you an API for looking up vehicles registered in Denmark: technical details, registration status, inspections, permits and similar data.
The data comes from Motorstyrelsen. It is Motorstyrelsen's public statistics extract, which anyone can download free of charge. We import it about once a week, convert it and serve it through the API. Motorbay is not affiliated with Motorstyrelsen, and Motorstyrelsen does not support or guarantee this service.
The data is provided as it is. We don't correct, check or complete it. It can be wrong, incomplete or
out of date, and it is usually up to a week behind Motorstyrelsen's own register. Motorstyrelsen doesn't
guarantee that the extract is updated, and neither do we. GET /v1/dataset and the Motorbay-Data-As-Of
header show which extract you are reading.
Don't use the data alone for decisions that matter. Before you buy, sell, insure, finance or approve a vehicle, or make any other important decision, check the facts with Motorstyrelsen or another official source.
There are no owners or people in the data. The extract holds no owner, keeper or insurance details. Some permits carry a free-text comment from Motorstyrelsen, which can contain a company's CVR number.
Your account
- You must be 18 or older.
- You tell us when you sign up whether you are a private individual or a business. Choose honestly: the consumer rules below depend on it. You can change it on your account page.
- One account is for one person or one business. Don't share an account.
- Keep your password and your API keys secret. Everything done with them counts as done by you. If a key leaks, delete it on your account page at once and create a new one.
- Give us a working email address. We send receipts, security notices and notice of changes to it.
Plans, prices and payment
- The plans, their prices, what they include and the charge per request over the included amount are on the pricing page. The prices there are the full prices. Nothing is added at checkout.
- New customers get a free trial before the first payment. The pricing page says how long it lasts.
- Payment is by card through Stripe. A subscription renews every month until you cancel it.
- Requests over your plan's included amount are billed after each month. Your account page shows how much you have used.
- We may change prices. We tell you by email at least 30 days before, and the new price applies from your first billing period after that. If you don't accept it, cancel before then.
Cancelling and withdrawing
- You can cancel at any time on your account page. The subscription then runs to the end of the period you have paid for and is not renewed.
- Cancelling after the withdrawal period does not give a refund for the rest of the period.
- Private individuals have a 14-day right of withdrawal. How it works, and what you get back, is in the refund policy.
How you may use the API
You may use the data in your own products and services, and show it to your own customers.
You may not:
- share your API key, or use someone else's;
- try to get around the rate limits, the monthly limit or the payment, for example by spreading requests over several accounts or keys;
- copy the whole dataset, or large parts of it, to offer it again as a database or an API of your own. The extract is free from Motorstyrelsen, if that is what you need;
- use the API for anything illegal, or to find, track or harass people;
- attack, overload or probe the service, or look for weaknesses in it without our permission. If you find a security problem, tell us as our security page describes.
The limits are in the guides: 60 requests a minute per key, and your plan's monthly amount.
When we may suspend or close an account
We may suspend an API key or an account without notice if it breaks these terms, puts the service or other customers at risk, or is used for fraud. We tell you why, unless the law stops us. If we close an account because of a breach, we don't refund the rest of the period.
We may also close the service as a whole. We tell you at least 30 days before, and refund what you paid for the time after it closes.
Availability and changes to the API
Motorbay is new. We work to keep it running, but we don't promise any uptime, and there will be maintenance
and outages. The status of the data is on /health/data.
We may add to the API at any time. We try hard not to break it: a change that would break working clients comes with notice in the API changelog and at least 30 days to adapt, unless a security problem or the law makes that impossible.
Liability
We are not liable for decisions you or your customers make based on the data, or for errors, gaps or delays in the data, since it comes from Motorstyrelsen as it is.
We are not liable for indirect losses, such as lost profit, lost data or lost business.
For anything else, our total liability to you is limited to what you paid us in the 12 months before the damage happened.
None of this limits liability that the law does not allow us to limit, for example for gross negligence or intent, or your rights as a consumer under Danish law.
If you are a private individual and the service is defective, the rules on defects in the Danish Sale of Goods Act (købeloven) can apply, and nothing in these terms limits them.
Your data
How we handle personal data is in the privacy policy. What the console stores in your browser is on the cookies page.
Changes to these terms
We may change these terms. We tell you by email and in the console at least 30 days before a change takes effect, unless the law requires it sooner. The console asks you to accept the new terms. If you don't accept them, you can cancel and delete your account before they take effect.
Law and disputes
Danish law applies. If we can't solve a disagreement together, a private individual can complain to the Danish Consumer Complaints Board (Forbrugerklagenævnet) at forbrug.dk. Disputes otherwise go to the Danish courts, at our home court unless the law gives a consumer the right to use their own.
